Terms and Conditions

You are invited to read these Terms and Conditions of Use (“Terms and Conditions”) carefully before purchasing a Birth, Civil Union, Marriage, Cohabitation, Free Status and/or Death certificate from https://certifikati.identita.gov.mt online portal. By ordering any of the certificates available on this online portal, you are hereby agreeing, without limitation or qualification, to be bound by these Terms and Conditions, which constitute a binding and enforceable agreement under Maltese Law between you (“the User”) and Identità, an Agency of the Government of Malta established by Subsidiary Legislation 595.07 and having head office in Valley Road, Msida, MSD9020, Malta (“Identità”).

Object

The Public Registry within Identità is the registration authority in Malta entrusted with maintaining records of life events occurring in the Maltese Islands and to Maltese nationals who were born, died, married or contracted civil union overseas. Through the Online Portal, you are able to order online one or more existing Public Registry civil status certificates (the “Certificates”), including Birth, Marriage, Civil Union, Cohabitation, Death and Free Status certificate against the payment of a state and delivery fee. As an optional service, certificates may be legalised and apostilled for official use outside of Malta. This is subject to an additional fee, as indicated in sub-section 2.3 below. Multi-lingual certificates for use within the European Union are also available, at an additional cost of €10.00 for each certificate ordered, as indicated in sub-section 2.1 below.

Fees

Certificates may be ordered upon payment of a state fee (as indicated in sub-section 2.1 below), a delivery fee (as indicated in sub-section 2.2 below), an optional fee for the legalisation / apostille of the Certificate(s) (as indicated in sub-section 2.3 below) and for the multi-lingual Certificate(s).

The purchase of Certificates is subject to the following state fees:

Delivery fees

Delivery fees vary according to the place and country of delivery, the quantity of certificates ordered, and the type of delivery method requested. You will be informed of the delivery cost upon checkout.

Legalisation and apostille

The optional legalisation and/or apostille service is purchasable for an additional fee or €12.00 per Certificate.

Payments and refunds

Payments for Certificates can be made online via debit / credit card through the electronic Payment Gateway of the Government of Malta and are subject to the terms and conditions of this section. This section does not exclude the applicability of any other terms and conditions of use issued by the “Issuing Banks”

For the purpose of this section, "Card" means a Visa, Mastercard and BOV Cashlink, as agreed for the time being to be processed by the Bank for the Cardholder. "Cardholder" means the person to whom a Card is issued or who is authorised to use the Card. "Acquiring Banks" means those banks that have reached an agreement with the Government of Malta for the use of the electronic Payment Gateway. "Us/We" means Identità, hereinafter referred to as Us/We and to whom the payment is payable. "You" means the Cardholder.

The following terms and conditions shall apply in respect of each and every electronic payment by means of a Card (henceforth Electronic Card (EC) Transaction).

You shall not complete an EC Transaction if You are, or should on exercising reasonable care, be aware that the Card has expired or is not yet valid, without prejudice to any obligations by You with Us.

Neither the acceptance by Us of the submission of any EC Transaction nor any payment by You or other act or omission of ours (other than an express written acknowledgement or waiver thereof by Us) shall constitute or be deemed to constitute any acknowledgement or waiver of compliance by You to warrant and agree that all transaction details so submitted are, within your knowledge, true and complete.

Payment shall be without prejudice to any claims or rights which We may have against You and shall not constitute any admission by Us as to the performance by You of your obligations under this Agreement and the amount payable to You.

Without prejudice to any statutory rights or obligations which either party may have, We shall be entitled at any time to refuse total or partial payment in respect of an EC Transaction in any of the following situations:

  • the EC Transaction is for any reason unlawful or unenforceable;
  • when the web services are not available;
  • there has been a breach by You of this Agreement, other than the breaches more specifically provided in this Clause 6, in connection with the EC Transaction.

In respect of an EC Transaction, You shall be provided with a record of the EC Transaction (by electronic means, surface mail or other methods acceptable to Us) and such record shall include:

  • a description of services provided or the type of tax payable;
  • your name and our name;
  • the transaction amount and currency.

We shall be under no liability to You (whether for loss of profit or otherwise) for any suspension, interruption, error or failure in our computer systems for performing or processing EC Transactions (or in any part thereof). We shall however, endeavour to provide an alternative method of payment in addition to the electronic Payment Gateway method without prejudice to the Terms and Conditions governing the provision of this service or the claims by the Government for taxation. Except as expressly provided to the contrary in this section 3 all terms, conditions, warranties, undertakings inducements or representations whether express, implied, statutory, or otherwise (including without limitation any terms about merchantability or satisfactory quality or fitness for any particular purpose) are excluded.

You will indemnify us on demand in respect of any actions, claims, costs, damages, demands, expenses and charges, losses and liabilities, suffered or incurred by Us arising directly from or in connection with any failure by You to comply with the provisions of this section 3.

Both parties expressly exclude liability for consequential loss or damage which may arise in connection with this section 3, or for loss of profit, business, revenue, goodwill, anticipated savings or otherwise.

Any refund or cancellation of certificates purchased directly from the Online Portal https://certifikati.identita.gov.mt is granted only at the sole discretion of the Public Registry. Follow this link to contact us.

Delivery

Your order will be delivered to the address you indicated when your order was placed. Identità does everything in its power to have the ordered Certificates delivered to you in the shortest time possible. Identità cannot, however, be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or by you, or because of some unforeseen event or an Act of God. In the event that you do not receive your package, an investigation will be conducted with the carrier and may take several days upon receipt of your claim. During this period of investigation, no reimbursement or re-delivery will take place.

Waiver

Any failure of Identità to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. The Terms and Conditions constitutes the entire agreement between the User and Identità, and governs your use of the service, superseding any prior agreements (including, but not limited to, any prior versions of the Terms and Conditions). If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Conditions will continue in full force and effect.

Termination of Use

Identità may, in its sole discretion, terminate or suspend your access to, and use of, this Online Portal without notice and for any reason, including the violation of these Terms and Conditions or for other conduct which Identità believes is unlawful or harmful to others. In the event of termination, you will no longer be authorized to access the Online Portal, and Identità will use any possible means to enforce this termination.

Data protection

The use of the Online Portal involves processing of your personal data by Identità. You are informed of the respective personal data processing activities on the Privacy Policy which can be accessed through https://certifikati.identita.gov.mt/en/Home/Privacy.

Changes to these Terms and Conditions

Identità holds the right to modify these Terms and Conditions. Notice of any modification to these Terms and Conditions of Use will be posted on this page and will be effective immediately upon notice, unless otherwise stated. Your continued use of the Online Portal signifies your acceptance to such modification. You should periodically visit this page to review the current Terms and Conditions.

Governing Law and settlement of disputes

These Terms and Conditions and the transactions contemplated hereby shall be governed by and construed and interpreted in accordance with the Laws of Malta. Any dispute between the User and Identità shall fall under the exclusive jurisdiction of the Courts of Malta.
